Research On The Protection Of Women'S Rights In The Division Of Marital Property

Because of the traditional division of labor, Chinese women's duty that sacrifice career development opportunities to assume family affairs make women take on more misfortune. Therefore marriage law should protect their legal rights and interests in the division of marital property. The rationale of the protection of women's rights in the division of marital property should be common ownership, negligence liability and distributive justice. To provide a better protection for women, we should make further efforts to modify and improve the related provisions. We should enlarge the scope of the marital property, recognize the compensation liability for all gross negligence and further clarify the conditions of the duty of supporting the needy spouse.
