Abstract
《刑法修正案(十)》将《刑法》第二百九十九条中的"公众场合"修改为"公共场合"并增设侮辱国歌罪.实践中对侮辱国歌罪的解释和司法认定存在很大争议,宜以第二百九十九条为蓝本、以犯罪构成要件为中心,辨析侮辱国歌的行为表现、"公共场合"的界定、"情节严重"的标准和政府机关的职能管辖等若干问题.
