中国经济诉讼是在无独立诉讼法依据下沿用民法规定.随着经济立法发展,复杂的经济纠纷日益增多,民法制度暴露出不能适应经济诉讼的缺陷,影响经济法作用的发挥.从理论上探讨经济法制度应具有的特点,改革中国经济诉讼法制度,是加强经济法建设的重要任务.
