Statistically, surgeons or procedure-based physicians have an extremely high likelihood of being named in a lawsuit at some point during their career. This can be a particularly stressful time. This manuscript outlines an approach to the situation, including common do's and don'ts during each phase of what often is a very long and drawn out process. It provides some insight into common problems or mistakes, timelines, as well as things to focus on during this taxing period. It is not a substitute for professional legal advice, but merely a guide and education source for something we do not often spend time on or devote resources to learn during residency training.
