试论我国行政程序法的立法构想——以《湖南省行政程序规定》为例

Abstract
民主政治要求政府依法行政,依法行政必须有规范政府行为的行政程序法.随着法治建设的推进,我国尽管先后出台了<行政处罚法>、<行政许可法>等规范政府行为的法律,但至今尚无统一的行政程序法典.在构建法治政府的语境下,我国急需一部统一的行政程序法.从宏观层面来看,我国行政程序法的立法模式宜采用权利保障模式和法典模式,应当确立公正、公开等基本原则,建立行政听证和行政责任保险两项基本制度.
